TERMS AND CONDITIONS FOR INDIVIDUALS
You Warranties to Us.
You warrant that you are at least 18 years old and possess the legal authority
to enter into this agreement and to use this website in accordance with the
terms and conditions. You agree to be financially responsible for all of your
use of this website as well as for the use of your name and credit card account
to pay for products and services purchased at this website by members of your
household, including minors living with you or your group. You also warrant that
all information supplied by you or members of your household is true and
accurate.
Reservations and payments
Hotels: At the time of reservation, a deposit of 100% per
person is required.
Packages, Programs or Tours with Hotels: At the time of reservation, a deposit
of 50% is required. Full payment is due 60 days prior to departure. If some
services have a different form of reservations and/or payments that depend of
our overseas contractors, you will be advised accordingly. There may be special
payment and cancellation policies incurred during holiday periods and for
certain cruises and special packages.
Airline Tickets: Some discounted airline tickets require
immediate payment. Passengers will be advised accordingly last day to purchase.
Cancellations
Hotels: Cancellations received in writing 15 days prior of your
scheduled arrival you will be charged 15% of the total amount /15 and 2 days
before your scheduled arrival, you will be subject to a charge of 50% of
one-night's room rate/ 48 hours before your scheduled arrival, you will be
subject to a charge of one-night's room rate, tax recovery charges and service
fees.
Packages, Programs or Tours with Hotels: Cancellations received
in writing within 45 prior to departure there will be a 15% of the total tour
cost per person/ between 15 and 45 days prior to departure will be charged 25%
of the tour cost per person/ between 8 and 14 days prior to departure will be
charged 50% of the total tour cost per person/ made 7 days or less prior to
departure will be charged 100% per person. In addition to any cancellation
charge levied by our overseas contractors.
Changes fees: Will be charged the additional cost for documents
reissued, special mailing, administration fees, etc. Others charge will depend
of our overseas contractors.
Refunds: All claims for refunds must be received in writing,
with details and substantiation, within 30 days from the end of services by
SouthAmerica Hotels. After that time request will not be handled. No refund will
be made for any change and/or cancellation of service and/or accommodations made
by the passenger during the operation of a tour or for any feature of the
program not used by the passenger during the operation of a tour. No refund for
any unused service which resulted from an act or default of the passenger
(obtain the necessary documents required to enter a country or the passenger's
loss of identification documents, tickets and/or vouchers, etc).
Rates: All rates are in US Dollars for the year in curse and
are subject to change without notice. SouthAmerica Hotels reserves the rights to
adjust the rates accordingly. Rates published are for tourist purposes, rates
may change for business purposes.
Responsibility: SouthAmericaHotels and Tours and
its staff act only as agents for the passengers making arrangements for
Airlines, Hotels, Tours, Transportation and others services. We do not assume
any liability whatsoever for any injury, damage, death, loss, robbery, accident, delay or
any irregular situation which may be occasioned by uncontrollable reasons or any
supplier, ground operator, hotel, carrier, company and/or person rendering any
of the services included in a tour. We do not accept any responsibility for
additional expenses incurred by the passenger due to delay, changes in schedules
or other causes. Southamerica Hotels reserves the right to make changes in any
itinerary in the event it becomes necessary to insure the safety, comfort or
well being of the passenger.
TERMS AND CONDITIONS FOR GROUPSur, or for commercial and/or common carrier equipment beyond the control of SouthAmericaHotels, such as air, land or water transportation, or for any additional expenses occasioned thereby.
TERMS AND CONDITIONS FOR GROUPS
General Terms : SouthAmericaHotels and Tours acts
only as an agent for the individual or corporate tour participant with respect
to third-party travel or other services and/or talent bookings.
SouthAmericaHotels assumes no responsibility nor liability for any delays,
delayed or changed departure or arrival times or locations, missed carrier
connections, property loss and/or damage, inclement weather, labor strikes, acts
of God, circumstances beyond the control of SouthAmericaHotels and Tours such as a
force majeure, terrorist act(s), war, quarantine, and/or criminal activity, any
accident, sickness, injury or death to person or property, or any mechanical
defect or failure, or any deliberate, reckless or negligent conduct of any
nature or kind, howsoever caused, in connection with any lodging accommodations,
food provider, transportation or other third-party services and/or talent
bookings in connection with any scheduled tour, or for commercial and/or common
carrier equipment beyond the control of SouthAmericaHotels, such as air, land or
water transportation, or for any additional expenses occasioned thereby.
Policies and Procedures: Group leaders or Agents will be
provided with a copy of our Group Tour Policy, via e-mail, fax, or mail, along
with a reservation contract. The accompanying group reservation contract must be
signed and dated by Travel Agent or legal authorized representative of the
group, indicating acceptance of and agreement with all terms of this group
policy.
The payment of a deposit, or the payment of the applicable individual tour fee
or group booking fee where required for the specific tour, indicate acceptance
of the terms and conditions stated in these Tour and Event General Policies,
which terms and conditions are also incorporated in the applicable tour
contract.
Tour payments must be made with a single payment.
The payment may be made by credit card, company check, certified bank check or
money order. If a company check, certified bank check or money order is not
received by the time limit, the credit card will be charged for the remaining
balance due. If no credit card number was given, the tour will be considered
cancelled.
For reservations made 30 calendar days or less before the scheduled tour date,
payment in full will be required, using either a credit card, certified bank
check, or money order, at the time of booking. If using a certified bank check
or money order, it must be sent by overnight mail.
THE FOLLOWING CANCELLATION POLICIES AND CHARGES APPLY TO ALL CONFIRMED
RESERVATIONS:
For cancellation BY A GROUP TOUR ADMINISTRATOR/AGENT OF A CONTRACTED GROUP TOUR
(OVERNIGHT/SHORT/EXTENDED TOURS):
Group cancellations have to be made in writing by fax or email. Phone
cancellations will not be accepted for group bookings. No exceptions.
Cancellations will be subject to the following charges:
a) From 95 through 119 days prior to date of tour departure or tour event: 15%
of the minimum required group booking tour fee;
b) From 70 through 94 days prior to date of tour departure or tour event: 25% of
the minimum required group booking tour fee;
c) From 31 through 69 days prior to date of tour departure or tour event: 45% of
the minimum required group booking tour fee;
d) Cancellation 30 days or less prior to date of tour departure or tour event, a
“no-show”, or an early return from the tour or tour event will result in the
forfeiture of 100% of the minimum required group booking tour fee.
In addition to the foregoing, any applicable cancellation fees and
administrative fees will also be assessed. Refunds or reimbursement for event
advance ticketing are subject to the cancellation policies and procedures of the
specific event provider(s).
These Cancellation Policies are strictly enforced. All requests for the
creation, planning, or booking require a signed Contract of Engagement or
Confirmed Reservation, whichever is applicable, before SouthAmericaHotels ‘s
services commence. Upon signed Contract or Confirmed Reservation, group tour
administrators, group tour participants, and individual tour participants
acknowledge and agree that the terms and conditions contained in the Policies
herein and in the applicable Tour Contract become immediately applicable and
legally binding.
Travel Insurance: SouthAmericaHotels and Tours strongly recommends
that all tour participants obtain sufficient and appropriate trip
cancellation/trip interruption insurance for their protection. In the event that
pre-tour cancellation is due to an individual’s unforeseen medical emergency,
disability or death, SouthAmericaHotels will determine if, or to what extent,
any uninsured tour fees might be reimbursable without incurring penalty(ies),
subject to its receipt of independent verification of the extenuating
circumstances.
Health Issues: Any and/or all physical or mental condition(s)
that may require special medical attention, (for example, the need for a
wheelchair), must be reported in writing to SouthAmericaHotels at the time an
individual or group tour participant makes his/her/its reservation in order to
organize accordingly groups needs.
Unforeseen Circumstances: If due to weather, commercial flight
schedules, or other unforeseen or uncontrollable factors, tour participants are
required to spend any additional night(s), each individual tour participant
/group tour will be responsible for his/her/its own lodging expenses, transfers,
meal costs and other expenses, if not covered by trip cancellation/trip
interruption insurance. No refund will be made by SouthAmericaHotels for any
unused portion of the subject tour fee due to these types of causes and/or
circumstances if not covered by the tour participant’s or group’s travel
insurance policy(ies), and/or if not reimbursable by third-party end providers.
Others: SouthAmericaHotels and Tours reserves the right to decline to
accept or retain any person as a tour participant at any time, if such action is
either warranted or deemed to be in the best interest of the rest of the
participants on the subject tour.
Baggage and all other personal effects are at the owner’s risk entirely.
Tour participants are encouraged to obtain sufficient and adequate insurance
covering baggage damage and/or loss.
SouthAmericaHotels and Tours reserves the right to verify the age of any child.
Guest must show up on time for each excursion. Late arrivals may result in your
group missing part(s) of the tour. There is no refund for arriving late or
leaving a tour early.
